One of the most important checks you can make before booking any house clearance company in Yorkshire is whether they hold a valid Environment Agency Waste Carrier Licence. This guide explains what the licence is, why it matters, and how to verify it takes under two minutes.

What is a Waste Carrier Licence?

A Waste Carrier Licence is issued by the Environment Agency and gives a business legal authority to transport controlled waste — which includes household furniture, appliances, and most clearance waste — for hire or reward. Without one, transporting controlled waste for payment is illegal under the Environmental Protection Act 1990. Any professional house clearance company should hold an Upper Tier registration.

Why does it matter who booked the clearance?

This is the point most homeowners and executors do not realise: if you commission a clearance and the operator fly-tips the waste, you can be held liable as the person who arranged the removal. The duty of care under Section 34 of the Environmental Protection Act 1990 applies to the original waste producer — that is you, the homeowner or executor. Using an unlicensed operator does not remove your liability. It creates it.

How to verify a Waste Carrier Licence

The Environment Agency operates a public register at environment.data.gov.uk/public-register. Search by company name or licence number. A legitimate company will provide their licence number without hesitation before any booking is confirmed.

CL Clearances holds Waste Carrier Licence CBDU291452, verifiable on the Environment Agency register. Charlotte Leighton personally attends every clearance and can provide documentation at any stage of the booking process.

Upper tier or lower tier — which one matters

Registration comes in two tiers and the difference matters when you are checking a quote.

Lower tier is free and permanent. It covers organisations carrying only their own waste, plus a few specific categories — councils, charities, agricultural waste. A lower-tier registration does not entitle a business to carry other people’s household waste for money.

Upper tier is the one a house clearance company needs. It costs money, has to be renewed every three years, and is the registration that allows a business to transport, buy, sell or dispose of controlled waste produced by someone else. It is what makes the Waste Transfer Note they give you worth anything.

CL Clearances holds an upper tier registration, CBDU291452. If a company shows you a lower-tier number for a house clearance, that is the wrong registration for the job.

What a Waste Transfer Note has to say

The note is your evidence that you met your duty of care. A valid one names both parties, gives the carrier’s registration number, describes the waste and roughly how much of it there was, states where it was transferred and on what date, and carries the relevant waste codes. Keep it for two years — businesses are legally required to, and householders are well advised to, because it is the document that answers the question if your old sofa turns up in a lay-by.

What actually happens if waste from your house is fly-tipped

This is the part people are surprised by. Under section 34 of the Environmental Protection Act 1990 the duty of care sits with the person who produced the waste, not only with whoever dumped it. If you paid someone to take your contents away and they tipped them on a verge outside Snaith, and your name and address are in a letter in the pile, the enforcement team comes to you first.

The defence is having taken reasonable steps: you checked the carrier’s registration, and you have a Waste Transfer Note. Without those, councils can and do issue fixed penalty notices of up to £600 to the householder, and prosecution carries an unlimited fine. “I paid a man in a van” is not a defence; “here is his upper-tier registration number and the transfer note” is.

Checking a licence in under a minute

  1. Ask for the registration number before you book — a legitimate company gives it without hesitation.
  2. Go to environment.data.gov.uk/public-register/view/search-waste-carriers-brokers.
  3. Search the number, or the company name if you only have that.
  4. Check three things: that it is upper tier, that the status is active, and that the business name matches the one on your quote.

If the name on the register is different from the name on the van, ask why before the work starts.

Red flags when comparing house clearance companies in Yorkshire

  • They cannot or will not provide a licence number
  • They advertise only on Facebook groups with no traceable business address
  • They quote significantly below market rate and accept cash only
  • They do not provide anything in writing before starting work
